The placement and purchase of an order with ® constitute the acknowledgment and acceptance of all terms and conditions listed below. ® reserves the right to make changes to its website and terms and conditions at any time.

PRICES

All prices listed in our website, advertisement and catalog do not include shipping & handling charges. All prices are mail order prices; extra fees may apply for pick up or will call. All prices and descriptions are subject to change without notice. Orders shipped to California residents must include 8.25% sales tax.

TYPOGRAPHICAL ERRORS

In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information received from our suppliers, ® shall have the right to refuse or cancel any order placed for product listed at the incorrect price. ® shall have the right to refuse or cancel any such order whether or not the order has been confirmed and your credit card has been charged. If your credit card has already been charged for the purchase and your order is canceled, ® shall immediately issue a credit to your credit card account in the amount of the charge.

WARNING

All parts sold by ®, except for street legal/DOT approved parts, are racing parts for off road use only. ® shall not be liable for any special, direct, indirect, incidental or consequential damages that might be claimed as a result of the failure of any part, including claims for delay, loss of profits, or labor. ® shall not be liable for any damage or injury to persons or property resulting from improper installation or misuse of any part. ® will not cover any loss in profit or labor due to errors in shipping, mispackaging, and/or extended delays for backorder items. ® shall not be held accountable for any misconception or disappointment associated with any product.

SPECIAL ORDERS

® will determine special order items. All special ordered items must be prepaid before processing your order. Special ordered items cannot be cancelled or returned.

CANCELLATIONS

Any order which is cancelled with ® after 24hrs from placement of order to the time of shipment will be subject to a cancellation fee of 10% (ten percent).

PAYMENT

® accepts all major credit cards, checks, money orders, and certified checks payable to ®. Bank transfers also accepted; $25.00 transfer service fee will apply. All checks will be subject to a minimum of (14) fourteen-business day waiting period to clear with our bank. Orders will not be processed or shipped until this waiting period is over. To eliminate this delay, please send a money order, cashier's check, and certified check or prepay by credit card. Credit card fraud will not be tolerated. All orders paid by credit card must be shipped to the cardholder's billing address or verified alternate shipping address. Orders will NOT be shipped if the address provided does not match the records of the credit cardholder's bank. Please DO NOT send cash, as we are not responsible for any loss that may occur with the US Postal Service.

SHIPPING

All orders are shipped signature required by an adult by either UPS or Fed Ex. In stock items usually ship within 24hrs after receipt of order. ® does not guarantee on time deliver for out of stock items. Any expected shipment dates given to customer are approximate. Out of stock items will be placed backorder.

RETURNS

All items returned are subject to a 25% (twenty-five percent) restocking fee. Returns are not accepted on special orders and custom orders. All other returns or exchanges are accepted within 30 days after date of invoice. It is the customers responsibility to contact ® within this time period to be eligible for a return. A (RA#) Return Authorization Number must be issued before returning product. You may contact us by way of telephone at (925) 516-2695 , Fax (925) 516-8901, or by email : Returns@ClutchandFlywheel.com. A RA# must be clearly marked on return packages, otherwise package will be refused. All returns must be unused, in the same condition as sold to buyer and in its original packaging. The returned item(s) must be accompanied with a copy of the original invoice. No returns or exchanges will be allowed if the item shows signs of having been installed, scratched, damaged or modified. If ® does not accept a returned item as being defective and/or returnable for any reason, the buyer must accept any incurred cost. It is the responsibility of the customer to verify the correct part before ordering and installing a particular part.

REFUNDS

A refund, exchange or core return will not be made until all items are returned to ®. Shipping and handling are non-refundable. Orders placed by credit card will be refunded to the same credit card account only. All other non-credit card orders will be refunded by either company check or store credit. Refused shipments sent back to ® do not constitute a refund or credit. ® reserve the right to charge the customer shipping & handling costs for the refused shipment and a 25% restocking fee.

INTERNATIONAL ORDERS

All orders outside of the United States must be paid in full by bank wire transfer (must add $25.00 to order) or Western Union in US Funds before any order will be processed. All foreign orders are final. No returns will be accepted; therefore it is the buyer's responsibility to order the correct part. ® does not guarantee proper fitment for buyer's foreign vehicle as all parts sold by ® are made for the American domestic market.

WARRANTY

All products sold by ®are only subject to the manufacturer's warranty. Warranty will not be honored if the customer’s mishandling, abuse or faulty installation causes the defect.
